These Terms of Service are maintained by Apex Loop Systems LLC to govern your access to and use of the VibeShift AI website, mobile application, and AI portrait generation services. Please read them carefully before using the service.
1. Acceptance of Terms
By creating an account, accessing, or using VibeShift AI, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the service. You must be at least 13 years old to use VibeShift AI.
2. Description of Service
VibeShift AI provides AI-powered portrait transformation tools that allow users to upload photos and generate stylized, transformed, or themed images. Features, styles, and output quality may change as we improve the service.
3. Accounts and Security
Account creation. You may need to create an account to access certain features. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
Account suspension. We may suspend or terminate your account if you violate these terms, abuse the service, or engage in fraudulent or harmful activity.
4. User Content
Your uploads. You retain all rights to the images you upload. By uploading content, you grant us a limited license to use, process, and display it solely to provide the service to you, including generating transformations and displaying results in your gallery.
Content restrictions. You may not upload or generate content that is illegal, infringing, defamatory, harassing, abusive, hateful, sexually explicit, violent, deceptive, or that violates the rights of others. You may not upload images of other people without their consent.
Right to remove. We reserve the right to remove content and suspend accounts that violate these restrictions or applicable law.
5. Credits, Payments, and Refunds
Credits. Some features require credits. Credits may be earned through daily allowances, promotional activities, or purchased through our payment processor. Credits are not transferable and have no cash value.
Payments. All purchases are processed by our third-party payment processor. By purchasing credits or subscriptions, you agree to their terms and authorize us to charge your selected payment method.
Refunds. Except where required by law, all purchases are final. Contact us if you experience a billing error and we will review it.
6. Intellectual Property
Our rights. VibeShift AI, its logos, trademarks, software, and all non-user-generated content are owned by Apex Loop Systems LLC or its licensors and are protected by intellectual property laws.
Generated images. Subject to compliance with these terms, you may use generated images for personal and non-commercial purposes. We do not guarantee any specific right, license, or clearance to use generated output in commercial contexts; you are responsible for ensuring your use complies with applicable laws and third-party rights.
7. Prohibited Conduct
You may not use VibeShift AI to: reverse engineer or scrape the service; circumvent rate limits or access controls; distribute malware; impersonate others; generate deepfakes or deceptive media intended to mislead or harm; or engage in any activity that violates applicable laws or regulations.
8. Termination
You may stop using the service at any time. We may suspend or terminate your access for any reason, including violation of these terms, with or without notice. Upon termination, your right to use the service ceases immediately; provisions that by their nature should survive termination will continue to apply.
9. Disclaimer of Warranties
VibeShift AI is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, secure, or produce specific results. AI-generated output may vary and may not always match your expectations.
10. Limitation of Liability
To the fullest extent permitted by law, Apex Loop Systems LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the service.
11. Indemnification
You agree to indemnify and hold harmless Apex Loop Systems LLC and its affiliates from any claims, damages, losses, or expenses arising out of your use of the service, your content, or your violation of these terms.
12. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these terms will be resolved in the state or federal courts located in Delaware.
13. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the service after changes constitutes acceptance of the revised terms.
